Railnova SA is a Belgium-based technology company providing IoT-enabled solutions for the railway industry. We are committed to protecting personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”). This Privacy Notice explains how we process personal data in the context of our website and our services (including Railfleet and Railgenius) and what rights you have with respect to your personal data.

Role of Railnova

Depending on the context, Railnova acts either as a data controller or a data processor:
Controller
Railnova acts as data controller for:
  • its website
  • marketing and prospect management
  • direct customer relationships and account administration
Processor
Railnova typically acts as a data processor when providing Railfleet, Railgenius or related services to customers. In this context:
  • the customer organisation acts as data controller
  • Railnova processes data on behalf of the customer and under their instructions

How Railnova handles your data as Controller

3.1 Processing of personal data related to the use of our websites

Visiting the website
When you visit our website, we automatically process certain data that is technically necessary to display our website. These data include your IP address, device type, browser type, the website you visited before, the pages of our website you visit and the date and time of your visit. This data is stored in the log files of our systems for a maximum of six months. The legal basis for processing your data is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in ensuring the functionality and security of our website.
Contact forms and enquiries
If you contact us via our website, we additionally process the data you provide in the contact forms or your enquiry, for example your name, your email address, your telephone number and your messages to us. In this case, the legal basis for the processing of your data is your consent pursuant to Art. 6 Para. 1 lit. a) GDPR.

3.2 Processing of personal data related to customer & account data (B2B context)

In the context of the business relationship with us, we may process the following categories of personal data of contact persons at (prospective) customers, suppliers, vendors and partners:
  • Contact information, such as full name, work address, work telephone number, work mobile phone number, work fax number and work email address; payment data, such as data necessary for processing payments and fraud prevention;
  • Further information necessarily processed in a project or contractual relationship with Railnova or voluntarily provided by the Business Partner, such as personal data relating to orders placed, requests, and project details;
  • Personal data collected from publicly available resources, integrity databases and credit agencies; and
  • If legally required for Business Partner compliance screenings (Business Partner Due Diligence): all publicly available information such as trade register excerpts, press coverage, financial information and information about relevant and significant litigation or other legal proceedings against Business Partners.
We may process the personal data for the following purposes:
  • Communicating with Business Partners about products, services and projects, e.g. by responding to inquiries or requests or providing you with information about purchased products;
  • Planning, performing and managing the (contractual) relationship with Business Partners; e.g. by performing transactions and orders of products or services, processing payments, performing accounting, auditing, billing and collection activities, arranging shipments and deliveries, facilitating repairs and providing support services;
  • Administrating and performing customer surveys, marketing campaigns, market analysis, sweepstakes, contests, or other customer activities or events;
  • Maintaining and protecting the security of our products, services and websites, preventing and detecting security threats, fraud or other criminal or malicious activities;
  • Ensuring compliance with legal obligations (such as record keeping obligations), export control and customs, Business Partner compliance screening obligations (to prevent white-collar or money laundering crimes), and our policies or industry standards; and
  • Solving disputes, enforce our contractual agreements and to establish, exercise or defend legal claims.
Legal basis of processing
The processing of the personal data is necessary to fulfil the above-mentioned purposes including the performance of the (contractual) business relationship with the Business Partner. The legal basis for the processing is – unless noted otherwise:
  • the performance of a contract (Art. 6 Para. 1 lit. b) GDPR),
  • the legitimate interest pursued by Railnova (Art. 6 Para. 1 lit. f) GDPR),
  • the compliance with our legal obligation (Art. 6 Para. 1 lit. c) GDPR) or
  • the explicit granted consent of our contact person (Art. 6 Para. 1 lit. a) GDPR).
Transfer and disclosure of personal data
  • We may pass on personal data to affiliated companies if necessary, to fulfil the above-mentioned purposes.
  • We may pass on personal data to court, public authorities or law firms, if we are legally obliged to do so or if this is necessary for the assertion, exercise or defense of legal claims.
  • In addition, we are supported by service providers (so-called data processors) e.g. for IT maintenance services. Those service providers process the personal data only on instructions from Railnova and are bound by contract to adhere to all applicable data protection requirements.
  • In some cases, the mentioned recipients of personal data might be based in countries outside the European Union (EU) or the European Economic Area (EEA) that may have a lower level of data protection than within the EU. In such cases, we will ensure an adequate level of data protection for personal data by other means. A transmission will only take place if the recipient signed EU standard contractual clauses with Railnova or has implemented Binding Corporate Rules. Retention Periods
Unless indicated otherwise at the time of the collection of the personal data, we erase your personal data if the retention of that personal data is no longer necessary (i) for the purposes for which they were collected or otherwise processed, or (ii) to comply with legal obligations (such as retention obligations under tax or commercial laws).

3.3 Processing of personal data related to the use of our social media channels

Calendly (meeting scheduling)
We use “Calendly”, a scheduling service of Calendly LLC, 271 17th Street NW, 10th Floor, Atlanta, GA 30363, USA, to let you book meetings with us via our website.
The booking widget is only loaded once you have given your consent. In this context, your IP address, browser and device information, your time zone, and the details you enter into the booking form (in particular your name, email address, company and request) are processed.
The legal basis for loading the widget is your consent (Art. 6 Para. 1 lit. a) GDPR); for arranging and holding the meeting it is Art. 6 Para. 1 lit. b) GDPR. Calendly acts as our processor under Art. 28 GDPR. Data is transferred to the USA on the basis of the EU Standard Contractual Clauses.

YouTube channel
We use the “YouTube” service of YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066 USA (represented by Google, Inc, Amphitheatre Parkway, Mountain View, CA 94043, USA) (contact the data protection officer) and operate our YouTube channel via this service. The following functionalities are available to you on our YouTube channel: interact with us and other users, participate in surveys and competitions, and comment on posts.
When interacting with you as a user of our YouTube channel, the following data is processed: date and time of the interaction, type and content of interaction (e.g. likes, direct messages, comments) and profile name. The privacy policy of Google, Inc can be accessed here. The partner privacy policy of Google, Inc. can be accessed here.
The processing of your personal data in the context of the operation of the YouTube channel is based on Article 6 Paragraph 1 Points b) and f) of the GDPR and serves the interaction with us and other users and the provision of information about our products and our company. As such, processing is necessary for the purpose of pursuing a legitimate interest.
The recipients of your personal data are internal departments. We do not transfer your data to a third country. Regarding the recipients and the third country transfer of Google, Inc., please refer to its privacy policy. We delete your personal data after fully responding to the direct communication or after removal of the post being commented on. In addition, illegal content is deleted as necessary. Regarding deletion by Google, Inc., please refer to its privacy policy.

How we handle your data as Processor

4.1 Platform usage data (Railfleet / Railgenius, etc)

If Railnova acts as a data processor when providing Railfleet, Railgenius or related services to customers, we process personal data for:
  • User activity within the platform (e.g. actions, timestamps, logs)
  • Technical and diagnostic data required for operation, support and security

4.2 Asset and IoT-related data

If Railnova acts as a data processor when providing Asset and IoT-related data, we process data:
  • collected from connected railway assets and devices
  • Sensor, diagnostic and performance data
This data primarily relates to equipment and operations, but may be associated with identifiable users depending on the customer's configuration.

Your rights

Subject to the requirements stipulated by the GDPR, you have the following rights:
  • access to your personal data,
  • the rectification of incorrect or incomplete data,
  • deletion of your personal data,
  • restriction of the processing of your personal data,
  • the right to receive your personal data in structured, commonly used and machine-readable format and the transfer of that data to another controller.
Right to object
Where we process your personal data based on our legitimate interest (Art. 6 Para. 1 lit. f) GDPR) and there are reasons based on your particular situation, you may have the right to object to the processing of your personal data. Especially you may object to the processing for the purposes of direct marketing.
Right to withdraw consent
Where we process your personal data based on your consent, you have the right to withdraw that consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
Where Railnova acts as processor, requests should be directed to the relevant customer (data controller).
